Of all the statutory obligations attached to letting a property in England, the annual gas safety check is one of the oldest and most consistently enforced — and it remains one of the most common compliance gaps landlords are caught out on, usually through oversight rather than any deliberate cutting of corners.
The core requirement. Any rental property with a gas appliance, boiler, gas fire, or gas supply of any kind must have an annual Gas Safety Check carried out by an engineer registered on the Gas Safe Register — the only body legally permitted to carry out this work in England, Wales and Scotland. Using anyone not on that register, however competent they may seem, doesn’t satisfy the legal requirement.
What happens after the check. The engineer issues a Landlord Gas Safety Record, commonly known as a CP12. This document must be given to the tenant within 28 days of the check being carried out, or, for a new tenancy, before the tenant moves in. It’s not enough for the certificate to simply exist somewhere on file — it has to actually be provided to the tenant, and it’s worth keeping a dated record of when and how it was given, in case it’s ever queried.
Why this matters beyond the immediate safety issue. A missing or expired gas safety certificate isn’t only a safety and criminal liability risk — it’s now also a practical obstruction to legal processes a landlord might need to use later. Courts routinely check for compliant safety certification as part of any possession claim, and a gap in gas safety records can complicate or delay a case that would otherwise be straightforward.
Record-keeping. Keep at least the last two certificates on file — the current one and the previous one — so there’s a continuous record showing the annual requirement has been met without a gap. Digital copies stored securely are fine; the requirement is about the check happening and being evidenced, not about a specific storage method.
A practical habit that avoids the most common mistake. The most frequent way landlords end up briefly non-compliant isn’t ignorance of the rule — it’s simply losing track of the exact renewal date and letting it slip past. Set a reminder well ahead of the expiry date, not on the day itself, since Gas Safe engineers in a busy area like Guildford can get booked up, and a check arranged at the last minute sometimes can’t happen before the existing certificate lapses.
